Prices
All prices are subject to alterations as a result of any changes in our costs, such as, but not limited to: oscillating hotel prices, currency fluctuations, or any other modifications in costs. We will honor our web-site tour price guarantee if payment is received in full before the date indicated and if all other conditions of that guarantee are met. Since Etaly Vacations does not offer airline transportation to Italy, Departure taxes, airline schedule changes, and itinerary adjustments are not covered under this guarantee. Consult your airline carrier for ticket rules and regulations. Gratuities are excluded from pricing considerations. ALL TOUR MEMBERS will have transportation from Italian airports to hotel and hotel to Italian airports arranged for them. Prices do not include transportation between your home and the airline terminal. Absolutely no refund will be made for any accommodations or services included in the tour that you do not use. In case of computer error, typographical error, or human billing error, we reserve the right to invoice participants with corrected billing.

Reservations and Payments
For our standard packages, a deposit of $300 per person and a signed contract are required to hold your reservation. For our tailor-made packages, a deposit equal to 20% of the total tour package and a signed contract are required for reservation. Credit cards are accepted to pay for deposits only (up to a maximum of $2,000). The remaining balance of either type of tour is due 60 days before departure and will only be accepted in the form of personal check, cashier’s check, wire transfer, and/or money order. Payments made within 30 days of departure require certified check or bank check payment. Payments that are received within 21 days of departure are subject to a $30 surcharge for sending documents via express mail.

When purchasing our tours through any other person or entity other than Etaly Vacations (including a travel agent), that person or entity acts strictly and solely as your agent in dealing with us. Etaly Vacations disclaims liability for payments made to such persons or entities until we receive such payment allocated for your account and we accept it as such.

Travel Documents
United States citizens require a valid passport when they travel to Europe. Non-citizens may or may not have other requirements to satisfy which should be verified immediately through the nearest Consulate and/or Embassy. Vaccinations to Italy are neither necessary nor required.

Airline and Airport Taxes and Charges
Etaly Vacations DOES NOT provide transportation via any airline carrier, cruise ships, or charter service. All taxes, security charges, and any other type of taxes or charges imposed by airlines, cruise lines, charters, airports, governments, etc., are not included in the tour prices. Please consult your transportation provider for all updated rules and regulations as transportation taxes are subject to change.

Substitutions
Etaly Vacations reserves the right, acting in good faith, to alter tour itineraries and substitute portions of the sightseeing, ports of call, tours, entertainment, hosts, hotels, restaurants, party and banquet locations, or any other accommodation.

Holidays and Changes
During local or national holidays abroad, certain facilities such as museums, sightseeing tours and shopping may be limited. In such instances or whenever necessary, Etaly Vacations will make slight itinerary adjustments in order to minimize tour member inconveniences. If, however, your enjoyment might be diminished by such minor limitations, please check with the appropriate tourist office before selecting a departure. Holidays, closing days and other circumstances may change the day of the week for scheduled “dining out”, sightseeing and other activities.

Baggage
Due to new airline travel regulations, each tour member is limited to one large suitcase and small carry-on bag. Airlines will charge extra fees for checked luggage that exceeds 62” (calculated by adding the width + height + depth). Etaly Vacations is not responsible for lost or damaged luggage as a result of airline, cruise line, charter, or any other transportation provider’s negligence.

Hotel Accommodations
The hotels listed on our site, brochures, and other literature will be used on almost all departures. If a change of hotel is necessary for any reason, Etaly Vacations will use a structure of equal or greater level.

Single rooms – Every hotel in Italy has a limited number of single rooms. Such rooms are available at a supplemental rate of $500 USD. While single rooms do provide privacy, they are often smaller than twin bedrooms and sometimes poorly located within the hotels.

Shared rooms - If you are traveling alone and wish to share a room with another tour member, we can try to work out agreeable rooming accommodations. If, however, your assigned roommate decides to cancel for any reason (even at the last minute) or if you are incompatible, we will be forced to charge you the $500 single supplement since the hotels make no distinctions.

Triple rooms are available in some hotels and they typically consist of a twin bed with an additional folding bed for third person. In order to qualify for a triple room, 3 persons must occupy the room at all times while on tour. This may or may not be comfortable for US standards.

Right to Exclude
Acting in good faith and at our own discretion, we reserve the right to reject acceptance of a tour member or to require any individual to withdraw from any tour. This will only be as a result of tour members being abusive of others or whose behavior disrupts the tour operation.

Tour Cancellation by Operator
From time to time, a tour departure may be cancelled when minimum participation requirements are not fulfilled. In such case, Etaly Vacation’s sole responsibility is to provide a refund without any other liability whatsoever. Furthermore, Etaly Vacations is not responsible for any tickets purchased in conjunction with the scheduled tour, non-refundable or otherwise.

Travel Insurance
Etaly Vacations has partnered with Quotewright.com to offer our tour members travel insurance protection. Any participating tour member that desires travel insurance protection can arrange for coverage online at Quotewright.com and can select coverage from several highly reputable independent travel insurance agencies (such as Travel Guard or Travelex). All cancellations and refund requests must be sent to Quotewright.com in writing. Your right to a refund is subject to their terms & conditions. Etaly Vacations is not responsible for negligence on the part of any travel insurance agency or non-refunded money due to misunderstanding of the terms & conditions of the travel insurance agency you contracted.

Cancellation Policy
Should you need to cancel your reservation for any reason; the following cancellation charges will apply. All cancellations and refund requests must be sent to us in writing and are subject to the following cancellation charges which are based on the price of the tour and the number of weeks prior to departure we receive your notice. Your right to a refund is limited. The fee incurred to change or cancel your air ticket is not covered by this policy.

Proof of Claim
Claim of illness, injury, or death must be strictly valid and supported by the submission of a detailed medical certificate signed by a board certified physician with the specificity and declaration that would be admissible in a court of law. In case of death, a death certificate with raised seal is required.

Refunds
When refunds are given and you accept such refund, you release us from all further liability and you thereby waive any and all additional rights and remedies under this contract or any applicable state, federal or foreign law.

Governing Law and Forum
The law of the State of Georgia, USA shall govern the interpretation of this agreement between you and Etaly Vacations. Furthermore, you agree that any legal action brought by either you or Etaly Vacations shall be brought in the state courts of the State of Georgia, County of Fulton and you hereby agree to personally submit to the jurisdiction of said courts.

Smoking
Please be advised that the laws governing smoking in Italy are not up to US standards. For tour member health and convenience, smoking will not be allowed on the motor coach or any other mode of transportation used while on tour. All attempts will be made to find non-smoking environments throughout the duration of our vacation packages. However, Etaly Vacations can not be made responsible for any inconveniences or health complications caused by exposure to second-hand smoke while on tour. For those wishing to smoke, regular breaks will be given throughout the tour.

Air Conditioning
We inform all prospective tour members that foreign air conditioning systems in public places, boats, hotels and motor coaches are not in compliance with US standards. All participating tour members are kindly asked to respect and honor such differences.

Arrive Early - Extend Your Stay
If you have arranged to arrive in Italy before your scheduled tour, or to stay in Italy after the conclusion of your tour with Etaly Vacations, please understand that your stay and your airport transfers will be at your sole expense and at your own risk.

Tour Members Needing Special Assistance
Any physical, emotional, dietary, or other need requiring special attention should be immediately reported to Etaly Vacations at the time of reservation. All reasonable efforts will be made to accommodate the needs of special assistance participants. However, after reasonable efforts have been made; Etaly Vacations is not responsible in the event that special assistance is denied by the hotels, restaurants, or any other suppliers’ of our tours. We regret to inform that the personnel of Etaly Vacations are not qualified and, therefore, cannot provide individual assistance to a tour member for any reason. Travelers who need special assistance that require a qualified companion must be accompanied by a qualified companion at all times during the tour and are required to satisfy payment in order to include such qualified companion to participate.

Children
Children over age 11 are welcome to participate in our tours. Tour programs are purposely designed for a mature, adult, audience. Therefore, any child under this age cannot participate in our tours.

Optional Tours
While on tour, a series of optional excursions and other activities to fill in free time will be offered. You are not required whatsoever to enroll in any such optional electives. They are strictly optional electives. Optional electives while in Italy may include, but are not limited to, museums, horseback riding, bike rides, golf, hot-air balloon rides, hang gliding, Aroma therapy, ceramic classes, cooking classes, and last but not least, test driving a Ferrari on the F-1 circuit. The cost for each activity can range widely from $25 to $1,000 per person. These optional activities can be prepaid by using your credit card or other form of payment before departing on your tour. Once you’re in Italy, however, payment for such optional activities must be made in the form of cash only (dollars or euros). All Optional Tours and rates can and do frequently change.

Etaly Vacations’ Responsibility
Without limitation, you agree that Etaly Vacations is not responsible for any injury, loss, death, inconvenience, delay, or damage to person or property in connection with the provision of any goods or services whether resulting from, but not limited to, acts of God or force majeure, illness, disease, acts of war or civil unrest, insurrection or revolt, animals, strikes or other labor activities, criminal or terrorist activities of any kind, overbooking or downgrading of accommodations, mechanical or other failure of airplanes or other means of transportation, or for any failure of any transportation mechanism to arrive or depart on time. Etaly Vacations, Inc., it’s employees, stakeholders, associates, affiliates, officers, directors, consultants, agents, constituents, and assigns (collectively “Etaly Vacations”), does not posses or control any unit or entity which provides goods or services for your trip, including but not limited to, airlines, maritime vessels, motor coach, or other transportation companies, lodging facilities, guide services, ground operators, suppliers or providers of optional electives, food service providers, and any other provider of goods or services on our tours. Therefore, all such persons of units and entities are independent contractors; and you agree that Etaly Vacations is not accountable for any negligent or willful act or failure to act of any such person of unit or entity or of any other third party not related to our operation. Tour members agree that they are also subject to the terms and conditions set forth on their airline, rail, charter, cruise line, or other transportation ticket and absolve Etaly Vacations from any responsibility as a result of their actions. Occasionally, the name ETALY VACATIONS may appear affixed to signs around some hotels, to modes of transportation, or elsewhere. You agree that such use of our name does not in any way signify administration, ownership, or management by Etaly Vacations. Rather, you agree that such name exposition is purely done as a means of identifying ourselves. Also, be advised that air-conditioning systems and smoking regulations in Italy (and Europe in general) are not up to U.S. standards. You agree that if you are required to spend any additional night(s) in Italy due to weather, flight schedules, or other uncontrollable factors out of our control, you will be responsible for all incurred expenses as a result of such. Passenger certifies not to have any mental, physical, dietary, or other condition or disability that could lead to imminent danger for him/her or other passengers while on tour. You agree that Etaly Vacations reserves the right to substitute hotels with those of a similar category as the ones’ advertised. Etaly Vacations reserves the right, acting in good faith, to alter tour itineraries and substitute portions of the sightseeing, ports of call, tours, entertainment, hosts, hotels, restaurants, party and banquet locations, or any other accommodation, and Etaly Vacations shall not be liable for any such changes.

Arbitration Agreement
Any claim arising out of or relating in any way to these Terms and Conditions, to the Etaly Vacations’ Responsibility clause, to the brochure, to the e-mail, or any other information relating in any way to the trip, shall be solely and exclusively settled by binding arbitration in Atlanta, Georgia, in accordance with the rules of the American Arbitration Association then existent. Receipt of your tour deposit indicates acceptance of the above Terms and Conditions and of the Arbitration Agreement.
